CALIFORNIA CONSUMER PRIVACY ACT PRIVACY POLICY

This Privacy Policy in compliance with the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“the CCPA”) provides information about how Masimo Corp. and its affiliates and subsidiaries collect, use, store, and otherwise shares California residents’ personal information and the rights that California residents may have under the CCPA (the “CA Privacy Policy”). If you are a California resident, this CA Privacy Policy applies to you.
NOTICE OF COLLECTION: The purpose of this Privacy Policy is also to give you notice about the categories of personal information Masimo collects from you and the purposes for which the personal information is used, as set forth below.

We may deidentify personal information so that it cannot reasonably be reidentified by us or by another person and may use this deidentified data for any reason permitted by applicable law. If we deidentify information that was originally based on personal information, we will maintain and use that information in deidentified form and will not attempt to reidentify the data, except as otherwise permitted under applicable law.
2. Sales or Sharing of Personal Information
While we do not disclose personal information to third parties in exchange for money, we may “sell” or “share” (as those terms are defined by the CCPA) limited categories of personal information. We may “sell” or “share” Identifiers and Internet and electronic network activity information, as described above, to third party advertising networks, social networks and data analytics providers. We do so in order to improve and evaluate our advertising campaigns and better reach customers and prospective customers with more relevant ads and content. As described in Section 7, you may opt out of such sales or sharing, including by submitting an opt-out request via our Cookie Preference Manager.
Requests to Opt Out. California residents may exercise their right to opt out online by submitting an opt-out request via our Cookie Preference Manager. In addition, our website responds to global privacy control—or “GPC”—signals, which means that if we detect that your browser is communicating a GPC signal, we will process that as a request to opt that particular browser and device out of sales and sharing (i.e., via cookies and tracking tools) on our website. Note that if you come back to our website from a different device or use a different browser on the same device, you will need to opt out (or set GPC for) that browser and device as well. We do not sell or share sensitive personal information, nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old.
3. Retention
Masimo retains the personal information we collect only as reasonably necessary for the purposes described in Section 1 above or otherwise disclosed to you at the time of collection. For example, we will retain your information as necessary to comply with our tax, accounting and recordkeeping obligations, as well as an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with our legal obligations.
4. Right to Know About Personal Information Collected, Disclosed, or Sold or Shared
You have the right to request that we disclose what personal information we collect about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you in accordance with the CCPA. 5. Right to Request Deletion of Personal Information
You have the right to request the deletion of personal information about you that we collected from you in accordance with the CCPA. To submit a request to delete personal information, please see the “Exercising Your Rights” section further below.
6. Right to Correct Your Inaccurate Personal Information
You have the right to request the correction of inaccurate personal information that we maintain about you in accordance with the CCPA. If you have an account with us, you may review and update your account information directly within your account.
7. Exercising Your Rights
To exercise your rights under the CCPA, you may submit a request to us using one of the following channels:

Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may also make a request on behalf of your minor child. You may designate an authorized agent by taking the steps outlined under “Authorized Agent” further below.
You may only make a right to know request twice within a 12-month period.
In your request to know, delete, or correct or in response to us seeking additional information, you, or your authorized agent, must:
If you do not provide enough information for us to reasonably verify your identity, we will not be able to fulfil your request to know, delete, or correct. We will only use the personal information you provide to us in a request for the purpose of verifying your identity and to fulfill your request.
Any disclosures we provide will only cover the 12-month period preceding receipt of your request.
We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
8. Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights
We will not discriminate against you for electing to exercise any rights under the CCPA.
9. Authorized Agent
You can designate an authorized agent to make a request under the CCPA on your behalf if:
If you provide an authorized agent with power of attorney pursuant to California Probate Code sections 4000 to 4465, it may not be necessary to perform the above steps, and we will respond to any request from such authorized agent in accordance with the CCPA.
10. How We Respond to Do Not Track Signals
We do not support the Do Not Track (DNT) browser setting. DNT is a preference you can set in your browser’s settings to let the websites you visit, including this site, know that you do not want the sites to collect your Personal Information.
11. Third-Party Links and Services
We provide links to third-party websites operated by organizations not affiliated with Masimo. We do not disclose your Personal Information to organizations operating such linked third-party websites. We do not review or endorse, and are not responsible for, the privacy practices of these organizations. We encourage you to read the privacy policy of each and every website you visit. This Privacy Policy applies solely to information collected by Masimo through the Services.
12. Changes to this Policy
From time to time, we may revise this CA Privacy Policy. When we do so, the changes will be posted, and the revised document will be available online and the “last updated” date above revised.
